NCFC’s Second Amendment Preservation Act!

With Joe Biden using Executive Actions and the threat of legislation in Congress to crush our gun rights, more gun owners than ever before are asking about the Second Amendment Preservation Act (SAPA.)

Here in North Carolina, North Carolina Firearms Coalition has been leading this effort from the beginning, pushing for HB189 sponsored early in the 2021 legislative session.

Of course, the leftists across the country have been mocking SAPA legislation, and gun-control organizations in D.C. have insisted that SAPA couldn’t become law due to the Supremacy Clause.

But they all stopped laughing when our sister organization in Missouri — the Missouri Firearms Coalition — passed the Second Amendment Preservation Act into law last just last month!

HELP NCFC PASS SAPA LEGISLATION!

SAPA legislation would nullify federal gun control laws here in North Carolina by requiring our state troopers, county sheriff’s deputies, and city police officers to ONLY enforce guns laws that have been passed by the North Carolina legislature. 

So Joe Biden could pass whatever gun control legislation he wants, sign any executive actions banning guns that he wants, and they wouldn’t be enforceable by peace officers here in North Carolina.

Sound too good to be true?

It’s not.

SAPA legislation is based on the 10th Amendment and the ‘anti-commandeering doctrine’ which states that the federal government may not simply ‘commandeer’ the state’s legislative authority and make them enforce laws that are contrary to state law.

What’s more, the United States Supreme Court has upheld the anti-commandeering doctrine for hundreds of years in a broad array of cases stretching from 1842 to as recently as 2018!

Clearly, the North Carolina legislature has the authority to stand up for gun owners and pass the Second Amendment Preservation Act. The question is, do they have the political guts to do it?

But for this legislation to be effective, it absolutely must have teeth, or it will be ignored by anti-gun mayors and department heads here in North Carolina.

You see, the idea of nullifying federal gun control isn’t new. When President Obama got into office, everyone was talking about the ‘Firearms Freedom Act’ as a way to stop his war against gun owners.

But this old legislation had a major flaw, however, in that it required the State Attorney General or the Governor to defend a gun owner whose gun rights were being violated by the federal government.

As we all know, trusting any Attorney General to stand in the gap for gun owners is just wishful thinking. Republican or Democrat, putting our security into their hands would be extremely risky.

Our SAPA legislation is much different. The legislation that we are having sponsored in Raleigh allows individual gun owners to bring law enforcement agencies who violate SAPA law (and their gun rights) to civil court on their own initiative to seek relief.

Doing this not only gives our SAPA legislation real teeth, it also protects North Carolina’s peace officers in a very real way.

You see, from the day Joe Biden was sworn into office, we have been hearing from troopers, deputies, and city cops who are concerned about being ordered to enforce gun control — which would force them to violate their oath to the Constitution or lose their job.

SAPA legislation protects North Carolina’s peace officers from having to choose between enforcing unconstitutional federal gun control laws or losing their job, by allowing them to point to SAPA law and reminding their departments that enforcing Biden’s gun control agenda would be a crime!

Simply put: SAPA legislation is our fallback point if Joe Biden is somehow able to pass federal gun control. It protects gun owners, peace officers, and the Second Amendment.

That’s why it’s spreading in ‘red states’ all over the country including states like Iowa, Wyoming, Georgia, Ohio, and Idaho.

But you and I both know that passing this legislation will not happen without a fight in the Capitol, not with the weakness that Governor Cooper and legislative leaders have shown over the years.
